Terms of Use

The short version

This page is the binding agreement, but here is what it says in plain terms. Nothing in this summary overrides the sections below.

• Menu Pick is an information site. Prices and hours may be out of date — check with the restaurant before relying on them.
• Most listings are unofficial. We are not the restaurant and cannot take your order.
• If you post a note, you keep ownership of it but let us publish it.
• Don't scrape the site, don't post other people's writing as your own, don't post anything false about a business.
• If you own a listed restaurant you can correct or remove your listing at any time, free.

1. Who this agreement is with

These Terms of Use are a contract between you and Menu Pick ("we", "us"), of 812 NY 104, Oswego, NY 13126, United States. They apply to menu-pick.com, all of its subdomains, and any service we operate that links to this page.

By using the site you accept these terms. If you do not accept them, stop using the site. You must be at least 13 years old to submit anything to us.

Menu Pick is operated from the United States and intended for users in the United States. We make no representation that the site is appropriate or available for use elsewhere; if you access it from outside the US you do so on your own initiative and are responsible for complying with your local law.

2. The information on this site

Menu Pick publishes restaurant information compiled from public sources and from restaurant owners who have claimed their listing. Each listing shows the date it was last checked.

Prices, opening hours, menu items and service options change without notice. A price shown here is a record of what a menu said on the date given. It is not an offer, a quotation, or a promise that the restaurant will charge that amount. Always confirm with the restaurant before travelling or relying on any detail.

3. Unofficial listings and trademarks

A listing marked unofficial is compiled by us from public sources. It is not written, approved or endorsed by the restaurant. Restaurant names, logos and trademarks belong to their owners and are used here nominatively, to identify the business being described. We claim no affiliation with, sponsorship by, or endorsement from any restaurant listed.

If you own or represent a listed business, you may:

• Claim the listing and edit it yourself, free of charge;
• Ask us to correct any detail; or
• Ask us to remove the listing entirely, no reason required.

We action verified removal requests within five business days.

4. Notes and other things you post

When you submit a diner note, a photograph or a correction, you keep ownership of it. You grant us a non-exclusive, worldwide, royalty-free, sublicensable license to publish, store, display and adapt it in connection with the site, including in excerpts and in our newsletter. You can ask us to remove your contribution at any time.

By posting, you represent that:

• the content is your own work, describing your own visit;
• it is not copied from Google, Yelp, Tripadvisor or anywhere else;
• it is honest, and you have no undisclosed connection to the business;
• it is not defamatory and does not infringe anyone's rights.

We read every note before it appears and may decline or edit it. Declining a note is an editorial decision, not a statement about you.

Menu Pick is an interactive computer service under 47 U.S.C. § 230. We are not the publisher or speaker of information provided by our users.

5. What you may not do

• Scrape, crawl or bulk-copy the site beyond normal search engine indexing, or use it to build a competing dataset.
• Post content you did not write, or content designed to promote or damage a business you are connected to.
• Impersonate a restaurant, an editor, or another person.
• Attempt to gain unauthorized access to any part of the site or its systems.
• Use the site for anything unlawful, or in a way that interferes with other people's use of it.

We may suspend or terminate access where these rules are broken.

6. Our content

The design, code, editorial writing, photographs we took ourselves, and the selection and arrangement of the directory are ours or licensed to us, and are protected by United States copyright law. You may link to any page freely and quote short extracts with attribution. You may not republish substantial portions or reproduce the directory in bulk.

7. Copyright complaints (DMCA)

If you believe material on Menu Pick infringes your copyright, send a notice under the Digital Millennium Copyright Act to our designated agent:

Your notice must include:

• your physical or electronic signature;
• identification of the copyrighted work claimed to be infringed;
• the exact URL of the material you want removed;
• your address, telephone number and email;
• a statement that you believe in good faith the use is not authorized; and
• a statement, under penalty of perjury, that the information is accurate and that you are authorized to act for the copyright owner.

We remove infringing material promptly on a valid notice, and we terminate the accounts of repeat infringers. If your material was removed and you believe that was a mistake, you may send a counter-notice to the same address.

8. Links to other sites

We link out to restaurants' own sites and to review platforms such as Yelp, Tripadvisor and Google. Those sites are not under our control. We are not responsible for their content, their accuracy or their privacy practices.

9. Disclaimer of warranties

THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. We do not warrant that the site will be uninterrupted or error-free, or that every detail will be current.

Some states do not allow the exclusion of implied warranties, so parts of this section may not apply to you.

10. Limitation of liability

To the fullest extent permitted by law, Menu Pick and its officers, employees and contractors will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss arising from reliance on information that had changed since we checked it.

Our total liability for any claim relating to the site will not exceed one hundred US dollars ($100).

Some states do not allow these limits, so parts of this section may not apply to you. Nothing here limits liability that cannot lawfully be limited.

11. Indemnification

You agree to indemnify and hold Menu Pick harmless from any claim or demand, including reasonable attorneys' fees, arising out of content you submit, your use of the site, or your breach of these terms.

12. Changes to these terms

We may update these terms. The date at the top of this page always shows the current version, and material changes are listed in the change history. If you keep using the site after a change takes effect, you accept the updated terms.

13. Governing law and disputes

These terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. Any dispute must be brought exclusively in the state or federal courts located in Oswego County, New York, and you consent to the jurisdiction of those courts.

Any claim must be filed within one year after it arises, or it is permanently barred.

14. General

If any part of these terms is held unenforceable, the rest stays in force. Our failure to enforce a provision is not a waiver of it. These terms, together with the privacy policy, are the entire agreement between us about the site.
